Overview
The Data Privacy Counsel will be responsible for overseeing all aspects of data privacy and protection for specifically assigned products/services. Additionally, this role involves advising on legal risks and obligations, developing privacy policies, and implementing compliance strategies to protect personal data and maintain client trust. The ideal candidate will have a strong understanding of privacy laws, particularly in the context of digital advertising and marketing. This is a full-time position, hybrid/office position. The position is a member of our Global Data Privacy Office reporting to the Assistant Chief Privacy Officer, North America.
Responsibilities
- Legal Compliance: Monitor privacy legislation and matters and ensure compliance with relevant privacy laws and regulations.
- Policy Development: Develop, implement, and maintain privacy policies, procedures, and best practices.
- Risk Management: Identify, assess, and mitigate privacy risks associated with marketing campaigns, data processing activities, and new technologies.
- Training and Awareness: Conduct training sessions for employees to promote privacy awareness and ensure adherence to privacy policies and practices.
- Contract Review: Draft, review, and negotiate data protection agreements, privacy terms in client contracts, and vendor agreements to ensure adequate data protection measures are in place.
- Notice Drafting: Draft consumer disclosures such as notices and consent disclaimers.
- Privacy Assessments: Conduct regular privacy assessments to evaluate the agency's data protection practices and identify areas for improvement.
- Incident Response: Participate in the response to any data breaches or privacy incidents, including investigation, remediation, and reporting as required by law.
- Stakeholder Collaboration: Work closely with cross-functional teams, including privacy operations, engineering, product, client services, security, HR, and marketing, to integrate privacy considerations into business operations and client projects.
- Advisory Role: Provide expert advice to senior management and project teams on privacy-related issues and strategic initiatives.
- Global Projects: Collaborate with global privacy counsel on the Groupe’s global privacy program.
Qualifications
- Juris Doctor (JD) from an accredited law school and membership in good standing with a state bar.
- Minimum of 4 years practicing law, and minimum of 1 year of experience in privacy law, preferably with experience in the digital advertising industry.
- In-depth knowledge of privacy laws, regulations, and industry best practices.
- Strong analytical skills with the ability to assess complex legal issues and provide practical solutions.
- Excellent communication and interpersonal skills, with the ability to effectively convey complex privacy concepts to non-legal stakeholders.
- Demonstrated ability to work independently and collaboratively in a fast-paced environment.
- Personable, team player and willing to take on new challenges as both the privacy landscape and the Groupe’s services evolve.
- Certification such as CIPP/US or CIPM is a plus.
